Removal of Agricultural Occupancy Condition

Our client owned a property historically located in open countryside and originally intended to accommodate a rural enterprise worker over 40 years ago. This 4 bedroom dwelling now forms part of a 'service village' and no longer in open countryside. It had been used as holiday accommodation in recent years.

We successfully demonstrated that the planning condition on this property is relevant to the consented development but this is no longer the case today. The consented dwelling has long ceased to be used as a rural enterprise workers dwelling and there have been significant changes to the local planning policy framework which mean that restrictive occupancy conditions in this location are no longer necessary.

Summary

Our client came to us to find out if there was a way to remove the planning condition on a property they owned. The dwelling was originally intended to accommodate a rural enterprise worker over 40 years ago.

Pembrokeshire County Council

Through assessment of the planning condition we successfully demonstrated that this should be lifted as it's retention could no longer be justified. We answered the following questions; Is the condition necessary? Is the condition relevant to planning? Is the condition relevant to the development? Is the condition precise and reasonable in all other aspects? Is the condition enforceable?
