Removal of Agricultural Occupancy Condition
Our client owned a property historically located in open countryside and originally intended to accommodate a rural enterprise worker over 40 years ago. This 4 bedroom dwelling now forms part of a 'service village' and no longer in open countryside. It had been used as holiday accommodation in recent years.
We successfully demonstrated that the planning condition on this property is relevant to the consented development but this is no longer the case today. The consented dwelling has long ceased to be used as a rural enterprise workers dwelling and there have been significant changes to the local planning policy framework which mean that restrictive occupancy conditions in this location are no longer necessary.
